Liability Waiver, Terms/Conditions, Photo Release
1. All participants must be at least 18 years of age or older.
2. BREAK TIME will allow participants aged 16-17 but must be accompanied by a parent/guardian.
3. All participants must bring a valid state photo ID.
4. All participants must use the equipment provided by BREAK TIME. No outside weapons will be permitted.
5. No persons under the influence of alcohol or drugs may participate.
6. No food or drink are permitted in the Rage Rooms.
7. All participants must use the provided safety equipment provided by BREAK TIME. This equipment must be on when inside the Rage Room.
8. No hitting the walls, floors, ceilings, lights or doors unless they are designated otherwise.
9. Only one person smashing at a time.
10. When you’re finished, dust yourself off and return to the changing room. We will clean the rooms.
11. No cell phones or recording devices are permitted in the Rage Room, without BREAK TIME’s consent.
12. BREAK TIME reserves the right to deny services due to age, behavior, medical condition or any and all other reasons deemed appropriate.
In consideration of my being permitted to use the services, equipment and facilities of BREAK
TIME LLC. (“Rage Room”), I hereby and acknowledge and accept the following terms and
conditions.
I hereby acknowledge, accept and agree of the assumption of risk that derives from the use of
or participation in a Rage Room and its services, equipment and facilities are inherently
dangerous. Participation in a Rage Room may place unusual stresses on the body and is NOT
recommended for persons suffering from, asthma, epilepsy, cardio disorders, respiratory
disorders, hypertension, skeletal joint or ligament problems or conditions, and certain mental
illnesses. Persons who are pregnant or suspect they are pregnant should not participate and
anyone intoxicated or presumed to be intoxicated will not be permitted to participate in any
Rage Room activities. By signing, you’re are acknowledging that you have consulted with a
medical professional about any concerns you may have about participation in the Rage Room.
I hereby acknowledge that I have no questions as to how to operate a baseball bat, hammer,
sledge hammer, crowbar or any other piece of equipment used in a Rage Room and all inherent
dangers and risks that are or are related to participate in a Rage Room.
This waiver and release of liability includes but is not limited to injuries, accidents or death,
which may occur as a result of services, equipment and Rage Room facilities.
The release of liability will also include but not limited to slipping, tripping, failure to wear your
protective gear, misuse of weapons and breakables, injuries resulting from flying debris or the
actions or omissions of others, cuts or abrasions, shock or stress injuries, the worsening of any
existing medical condition or failure to listen to BREAK TIME’S employee instruction.
Release in consideration of my use of the Rage Room’s services, equipment, facilities and or
participation in any BREAK TIME activity, fundraiser as well as its officers, managers, owners,
agents, employees from any and all liability, suits, claims, causes of action, demands, damages
(including attorney fees and expenses, losses or costs of any nature whatsoever incurred by me
or that are in any way related to or arising out of the use or intended use of the Rage Room’s
services, equipment and facilities, whether or not supervised, including, without limitation, all
claims of property damage, personal injuries whether or not there are allegations of neglect or
omissions on the part of any other party, including the Rage Room.
I hereby agree to indemnify BREAK TIME as well as its members, officers, managers, owners,
agents, employees and contractors from any and all liabilities, suits, claims, causes of action,
demands, damages, losses or costs of any nature whatsoever arising out of or in any way
related to my use of or movement in or throughout BREAK TIME, its facility or use of
equipment, whether or not there are any allegations or charges of negligent acts or omissions
on the part of any other parties.
I acknowledge BREAK TIME reserves the right to deny access to its facility to any individual for
any breach of BREAK TIME’s Rules & Regulations, or for any conduct determined as unsafe or
inappropriate.
This agreement shall be effective and binding upon my heirs, next of kin, executors,
administrators in the event of my death or incapacity.
By signing this agreement, I waive my right to bring court action to recover damages or to
obtain any other remedy for injury or death to myself or any damages to my property, however
caused, arising out of my use and participation of BREAK TIME’S services, equipment and
facilities and agree to pay all reasonable attorney or other expenses incurred by BREAK TIME as
a result of any claims made by me or on behalf in contravention of this agreement.
I have had sufficient time to read this agreement as well as the opportunity to ask questions
about this waiver. By signing this agreement, I acknowledge that if anyone is hurt or property is
damaged while I am on the premises, I may be found by a court of law to have waived my right
to maintain a lawsuit against BREAK TIME as well as its members, officers, owners, managers,
employees, agents and contractors, on the basis of any claim from which I have released them
herein.
Photo Release
By entering Break Time and by your presence at Break Time, you
consent to be photographed, filmed and/or otherwise
recorded. Your entry constitutes your consent to such
photography, filming and/or recording and to any use, in any
and all media throughout the universe in perpetuity, of your
appearance, voice and name for any purpose whatsoever in
connection with any ‘Break Time’ publications or
productions.
You understand that all photography, filming and/or
recording will be done in reliance on this consent given by entering ‘Break Time’.
